These Terms and Conditions (“Terms”) govern your access to and use of the website, products, and services provided by QuickHost. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you must not use our services.
1) Services
QuickHost provides cloud hosting, infrastructure, and related services as per the selected plan. Features, service levels, availability, and resource limits vary by plan. We may update, modify, or discontinue any service (with prior notice where reasonable) to maintain platform integrity and improve functionality.
2) Account Registration & Security
- You must provide accurate, complete registration details and keep them updated.
- You are responsible for safeguarding your account credentials and all activities under your account.
- Notify us immediately of any unauthorized access or security breach.
3) Billing, Payments & Refunds
Fees are charged based on your chosen plan and billing cycle. Payments must be timely to avoid suspension or termination. All fees are non-refundable except as required by law or explicitly stated in a QuickHost policy or SLA. You authorize us to charge your payment method for subscription renewals unless you cancel before renewal.
4) Acceptable Use Policy (AUP)
You agree to comply with all applicable laws and our AUP. Prohibited activities include (but are not limited to):
- Hosting, transmitting, or distributing illegal content or content that infringes intellectual property rights.
- Launching DDoS attacks, port scanning, spamming, phishing, malware/botnet operations, or other abusive behavior.
- Attempting to access or interfere with other users’ accounts, services, or QuickHost infrastructure.
5) Data Protection & Backups
We implement industry-standard security measures to protect your data. However, you are responsible for maintaining current backups of your content. QuickHost is not liable for data loss resulting from your failure to back up or from circumstances beyond our reasonable control.
6) Customer Content & Responsibility
You retain ownership of the content you host with us. You are solely responsible for the legality, reliability, and appropriateness of your content. You represent that you have the necessary rights to store, process, and distribute such content via our services.
7) Resource Usage & Fair Use
To ensure stability for all customers, we may apply fair use limits or temporarily throttle resources if usage materially impacts platform performance. We will make reasonable efforts to notify you and suggest plan upgrades if required.
8) Suspension & Termination
- We may suspend or terminate access for non-payment, serious AUP violations, or security risks.
- Upon termination, your services may be disabled and data may be deleted. Retain your own backups.
- You may cancel at any time via your client area; cancellation takes effect at the end of the current billing period unless otherwise specified.
9) Warranties & Disclaimers
Services are provided on an “as is” and “as available” basis. Except as expressly stated in a written SLA, QuickHost disclaims all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, error-free, or completely secure service.
10) Limitation of Liability
To the maximum extent permitted by law, QuickHost is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or revenue. Our aggregate liability arising from or related to the services shall not exceed the fees paid by you for the affected service in the three (3) months preceding the event giving rise to the claim.
11) Indemnification
You agree to indemnify, defend, and hold harmless QuickHost, its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your content, your use of the services, or your violation of these Terms or applicable law.
12) Changes to the Terms
We may update these Terms from time to time. Material changes will be posted on this page or communicated through your client area or email. Your continued use of the services after changes take effect constitutes acceptance of the updated Terms.
13) Governing Law & Jurisdiction
These Terms are governed by the laws of India. The courts located in Noida, Uttar Pradesh shall have exclusive jurisdiction over any disputes arising from or relating to these Terms or the services.
